Purpose: The purpose of this policy is to establish clear guidelines for the use of privately owned land and facilities by The Mini Mountain Farm Sanctuary Inc. for its operations. This policy ensures that the use of such properties aligns with the organization's mission and operational needs while respecting the ownership rights of the President.
Scope: This policy applies to the use of the President’s personal deeded property, including land, barn, and designated outbuildings, for activities and operations conducted by The Mini Mountain Farm Sanctuary Inc.
The current President, Nastassja Vitale, of The Mini Mountain Farm Sanctuary Inc. authorizes The Mini Mountain Farm Sanctuary Inc. to use their personal deeded property, including designated portions of the land, designated barns, and designated outbuildings, for the purposes of conducting the organization’s operations, including but not limited to animal sanctuary activities, educational programs, and events promoting sustainable agriculture practices.
The use of these facilities by The Mini Mountain Farm Sanctuary Inc. does not constitute a transfer of ownership, and the property will remain under the private ownership of the President unless specified otherwise in a legal agreement or through a future donation.
The terms and conditions under which The Mini Mountain Farm Sanctuary Inc. may use the specified property will be outlined in a separate Use Agreement, to be reviewed and agreed upon by both the President (as the property owner along with any co-owners of said property) and the Board of Directors.
The Use Agreement will specify the duration of use, the specific areas of the property that are included, any restrictions on use, responsibilities for maintenance and repairs, insurance requirements, and any compensation or reimbursement for use of the property.
The Mini Mountain Farm Sanctuary Inc. is responsible for the regular maintenance and cleanliness of the used facilities to ensure they are kept in good condition.
Any improvements or alterations to the property must receive prior written approval from the President. The Mini Mountain Farm Sanctuary Inc. is responsible for ensuring that all improvements comply with local zoning and building codes.
The Mini Mountain Farm Sanctuary Inc. shall maintain adequate insurance coverage for its activities on the property, including liability insurance to protect against claims arising from its use of the facilities.
Either party may terminate the use of the property by providing written notice to the other party, as specified in the Use Agreement. Upon termination, The Mini Mountain Farm Sanctuary Inc. shall vacate the property and return it to the condition it was in prior to use, subject to normal wear and tear.
Should the President decide to donate or sell the property to The Mini Mountain Farm Sanctuary Inc. in the future, such a transaction would be subject to approval by the board of directors and must comply with all legal and regulatory requirements.
Compliance with this policy and the terms of the Use Agreement is mandatory for all parties involved. Any disputes or issues arising from the use of the property should be addressed through mediation or via remedies outlined in the Use Agreement.
